The effect of the Consumer Protection Act on the Vacation Owners Association of South Africa

Paul Esselaar was invited to speak to the Vacation Owners Association of South Africa (VOASA) on the 30th August 2010 where he was asked to comment on four main issues concerning this industry relating to the Consumer Protection Act, namely:

  1. Reservations of rooms ? what is overbooking?
  2. Fixed Term Contracts
  3. Is an exchange program a loyalty program?
  4. What are the rules relating to Promotional Competitions?

Apart from the legal questions that were answered, what this conference clearly demonstrated was that the Consumer Protection Act affects different industries in different ways, some of which can be unintended. The importance of an association (such as VOASA) which can represent the industry and creates the norms for the industry as well as make representations to the government (in this case the Department of Trade and Industry) cannot be overstated.
